Civil Process processes and serves Summonses, Subpoenas, Temporary Injunctions,
Baker Acts, Marchman Acts, Notices, Tax Deeds, Evictions and Levies for Manatee

The Civil Process Office is located in the Manatee County Sheriff's Office Operations

Office hours are: Monday - Friday, 8:00 am to 5:00 pm.
REQUIRED TO LEVY:
Original instructions for Levy containing the following:
- Court issuance.
- Case number.
- Caption of case (plaintiff vs defendant).
- Date instructions prepared.
- Must be addressed to the Sheriff of Manatee County.
- Debtor’s name and last known address.
- Attorney of record for debtor, address and phone number (if none it needs to state
so).
- Specifically described personal property and location of property subject to levy
even if it’s the same as the debtor’s address (for real property you must include
the legal description and physical address of the property).
- Balance due and owing on the Writ of Execution (including interest through date
of instructions).
- Signature, address, phone number of plaintiff, his/her agent or attorney.
- Specific paragraph addressing stating that the plaintiff or requesting party shall
be responsible for any and all costs of the levy and sale, including the costs which
may be involved should bankruptcy be filed. The plaintiff or requesting party shall
be responsible for any wrongful levy and the Sheriff will be held blameless for
any damages whatsoever when following these instructions.

Real Property-Need affidavit of creditor or creditor’s attorney reflecting any

Cost Deposit as follows:
- Vehicle $2500.00
- Each additional vehicle $1500
- Real Property $1000
- Anything that is Court Ordered to levy and leave $1000
- Stocks $1000
All other property to be levied on will require a specific list to our office so
that a cost deposit may be estimated.
NOTE: WE ONLY ACCEPT CASHIER’S CHECKS, MONEY ORDERS, TRAVELER'S CHECKS,
AND IF BROUGHT IN PERSON, CASH FOR COST DEPOSITS.
FEES FOR PROCESS:
Pursuant to recently passed Senate Bill 412, effective July 1,
2009, the fees for civil process under FSS 30.231 will be as follows:
- $40.00 - per person / per case number.
- $40.00- Process requiring service only (including but not limited to, summons, subpoena,
notice of hearing, motion, etc)
- $90.00 - Writs of Replevin
- $90.00 - Writs of Possession
- $90.00 - Writs of Attachment
- $90.00 - Writs of Bodily Attachment
Alias and Pluries of these types of papers will no longer be ‘no
charge’. They will be charged according to the above.
OUT OF STATE PROCESS:
The service of process issued by a court of a state other than Florida will be made
in accordance with Florida statutes, rules, and procedures.
ADDITIONAL Out Of State Fees (if required):
- $10.00 - Personal Service (when you must have the person named served and only that
person; when substitute service is not acceptable – our substitute service is anyone
at the same place of abode who is 15 years of age or older and does NOT include
mailing a copy to them also).
- $2.00 - Affidavit (if you require an affidavit other than our return of service).
- $2.00 - Notary (if you require the above affidavit to be notarized).
- $5.00 - Description (description of the person served).
Payment may be tendered in the form of cashier’s check, money order, or business
check. If you send a business check, you must also include a copy of the drivers
license of the person that signed the check.
We require an original or certified copy, PLUS a copy for service with any attachments
that may be required. Please also make sure that the address for service is complete
and is in Manatee County.

We are electronically filing the original paper and return of service to the Manatee
County Clerk of Court. This applies to all cases filed in Manatee County. Copies
of paperwork filed through Manatee County can be obtained by accessing the Manatee
County Clerk of Court website at www.manateeclerk.org. We will continue to
mail back original papers and returns of service for out of county and out of state
cases.
